LEGAL ADVICES


The lawyer of association "Consent", Nana Gogokhia regularly conducts legal advices. Let me give you a few examples of these consultations.

IDP A.G.from Tamarasheni (Kurta municipality) addressed the lawyer. She notified the lawyer that her son was serving his military duty in Afghanistan and while returning back, he wanted to pass the registration, but she was told that his son was not allowed to do so. This young man is 23 years old. Before military service he had the status of internally displaced person, but now he does not.

Uncertain situation is in the family of I.G., there are three adult children - 23, 20 and 25 years old. Younger has a status of DP, elders - not. The question is - why? It turns out that they did not have birth certificates, as they were born at home. After a while, they’ve got the certificates, where the birth place was written Rustavi. Because of this, Internally Displaced Persons from the Occupied Territories, Accommodation and Refugees of Georgia refused to give the status of IDPs to the youngsters. The lawyer offered to help them and asked for relevant documents.

A displaced family, which consists of seven members, lives in two rooms. Of course they do not have enough space and want to expand their housing. The lawyer explained them what documents are required for the transmission to the Ministry of Internally Displaced Persons from the Occupied Territories, Accommodation and Refugees. The family meets the criteria developed by the Ministry (social vulnerability status, disabled persons, under age children). If the family will present these documents, it must have hope for additional space.

Domestic violence - one local woman spoke about this subject. Her husband is beating and insulting her. The woman has two under age children. She wants to sign a divorce and to take children to Baku, with relatives. But her spouse does not give her the right to do so. The fact of violence was recorded in the police station. The lawyer advised – to refer to the non-governmental organization that works in the field of human rights and will defend her rights in court for free.
